Brexit has thrown ICO skeleton into flux, admits information commissioner

GDPR and building trust

Denham pronounced while a EU referendum outcome had done her pursuit some-more challenging, a ICO is well-prepared and will continue to yield recommendation and superintendence around a EU’s General Data Protection regulation (GDPR).

Denham pronounced it is “extremely likely” that GDPR will be live before a UK leaves a EU. “The GDPR is already in force, it is only that member states are not thankful to request it until 25 May 2018,” she said.

Denham pronounced all UK companies that wish to do business in a EU will have to approve with a GDPR. She combined that a vital change in a law is about giving consumers control over their data, that ties in with building trust and is also partial of a ICO’s philosophy.

“No matter what a destiny authorised attribute between a UK and Europe, personal information will need to flow. It is elemental to a digital economy,” she said.

“In a tellurian economy, we need coherence of law and standards – a GDPR is a clever law and, once we are out of Europe, we will still need to be deemed adequate or radically equivalent.”

When a UK leaves a EU, that is expected to be 2019 or later, a new information insurance law will need to be in force, pronounced Denham.

“I’m carrying active discussions with ministers and comparison officials in government, and have transmitted a perspective on a destiny of information insurance law,” she said.

“We trust that destiny information insurance legislation, post Brexit, should be grown on an evolutionary basis, to yield a grade of fortitude and transparent regulatory messages for information controllers and a public.

“The aim here is not a information insurance regime that appeals since it is overly messy or ‘flexible’. The aim is a on-going regulatory regime that stands adult to scrutiny, that doesn’t leave a UK open to carrying rocks thrown during it by other regimes. And that has coherence and endowment with a Europe,” she said.

While regulators generally do not lobby, and eventually work with a law supervision provides, Denham pronounced when a review is about a destiny of information insurance in a UK, a ICO is dynamic to be partial of that conversation.

“We have 30 years’ knowledge as a regulator in a changing environment. We don’t wish to speak legislative minutiae, though to demeanour during a pivotal beliefs that should underpin a destiny of remoteness law in a UK,” she said.
